Rideshare drivers illegal activities Uber/Lyft

Here is another illegal strategy uber and lyft drivers learned quite quickly to maximize their profits and to stay on top of the taxi/uber game......large number of rideshare users are regular customers who catch a ride every day to work, from work, twice a week to doctor's appointments, once a week to airport, etc. Here, how it works, Customer instead requesting uber or lyft driver trough the platform, they call drivers directly on their cell phone for premium service, a driver who they already know..... With rates so ridiculously low, customer don't even mind to pay the driver directly + tip, .....at this point they even feel about them self as being socially correct by bypassing uber /lyft platform and supporting "a little guy" ...Though, the little they know, every time they get involved in this kind of activity, they basically travel completely uninsured.... ....
Here is the question, who we should blame for customers making dangerous decisions? a uber driver who is pretty ignorant to local rules and regulations (he wasn't informed by uber or city about possible dangers),? a passenger, who tries to save money on transportation and happily subscribes to uber's bogus press releases or may be uber for trying to make a buck for their shareholders ? ....
IMO, NON of the above, GUILTY OF THIS MESS ARE POLITICIANS WHO ALLOWED UBER TO OPERATE AGAINST ALL THE RULES, REGULATIONS, LAWS AND COMMON SENSE......................SO, IF YOU GET HURT IN UBER CAR OR GET HURT BY IT, don't go after uber which is entrenched in legal system and employs top lawyers, GO LEGALLY AFTER CITIES and STATES who's representatives allowed that to happen.....I guess in legal proceedings against public entities like city, you can throw in antitrust laws, civil laws, discrimination laws, lost wages, etc
If you think, it's impossible, I am pleased to inform you that it had happened before eg. in City of Ottawa.....

Traditional taxi cab companies have opposed the shady, corner cutting practices of ride-sharing operations like Uber since the San Francisco based software company began operating cut-rate transportation services to the northern California city. Now that companies like Uber and Lyft and Sidecar, the three giants in the billion dollar ride sharing business, are openly defying both the law and the establish ride for hire industry, legislators and lawmakers are beginning to see the importance of making these new kids in town pay the piper like their traditional transportation industry counterparts have been doing for many years.
District attorneys from both Los Angeles and San Francisco to the app-based transportation companies with stern warnings about their misleading statements to their customers and the public in general concerning what many see as serious safety issues. The letters to the three largest ride-share companies also contained accusations that the ride-sharing organizations are guilty of refusing to follow state laws and of incorporating illegal practices and the corresponding fines and penalties as a normal cost of doing business. In many cities Uber actually pays the fines imposed on their drivers by local police and courts.
San Francisco Dist. Atty. George Gascón has stated that Uber, Lyft and Sidecar need to correct multiple civil violations of state and local laws. He promised that if the app-based companies continue to disregard the law prosecutors will begin filing restraining orders as well as begin to assess the companies heavy fines.
The prosecutors' letters are the just  latest salvo by local governments in the ongoing war over how these Johnny-come-latelies to the transportation business attempt to undermine the existing structure of the industry by circumventing safety and permitting procedures that are designed to protect both the customers and drivers of these scofflaw companies. The companies allow customers to summon rides using smartphones and mobile devices based apps, and drivers transport passengers in their personal vehicles rather than licensed and inspected vehicles like traditional taxi companies are required to use. The latest investigations began in response to "a multitude of very serious complaints from both customers and legitimate taxi and limousine companies." Gascón said. The charges leveled by lawmakers include allegations  that the firms have failed to comply with multiple laws and local regulations that govern airport pickups and fare pricing. A recurring concern expressed both in California and nationwide is the fact that the ride-share have falsely told consumers that they perform background checks that  ensure their passengers that the drivers have no criminal record or previous driving violations.
Uber and Sidecar representatives said their firms' background checks comply with state law although they did not provide specific details regarding either the statutes they refer to or the exact background check process they claim to be employing. Echoing the vague defense the companies have been using in other cities, the reps for these companies claim that the charges are a result of misunderstandings. Their standard line is always something along the lines of this recent quote from Sunil Paul, the chief executive and founder of Sidecar:"We have a common interest," Paul said before a meeting with prosecutors "They have a high priority on safety, and our No. 1 concern is safety for riders, drivers and the public." Most experts agree that there is little truth to this claim and that the ride-share companies have historically shown little or no concern for the safety of either their passengers or their drivers. I think it is painfully obvious that their “No. 1 concern” is the billions of dollars of revenue at stake. Another commonly used, but inherently flawed defense used by the scofflaw companies is that they are merely ‘software providers’ and thus they are not really in the transportation business at all. Their flawed logic wears mighty thin under even the most casual scrutiny. It is no surprise that again, virtually all of the legal experts that have spoken out on the issue consider this line of reasoning unfounded and without any legal merit whatsoever.
What has become increasingly clear is that these companies are getting what they deserve and their time of making billions of dollars at the expense of legitimate transportation providers and local governments is quickly drawing to a close. If  California, the most supportive and lenient entity in terms of trying to work with these companies, has finally had enough of the lying and circular legal arguments Uber and their ilk employ, the rest of the country, and the world, can’t be far behind. I guess that is what happens when you bite the hand that feeds you, isn’t it?

DA: 16 Kennedy Airport taxi dispatchers arrested in bribery scheme

Sixteen taxi dispatchers have been arrested and charged in a bribery scheme in which they solicited kickbacks from cab drivers who were then allowed to cut lines at Kennedy Airport, bypassing long waits for fares, authorities said Wednesday.
The arrests were announced by Queens District Attorney Richard A. Brown and Port Authority Inspector General Robert E. Van Etten, who said the dispatchers were all employed by subcontractor Gateway Group One Frontline Services.
The scam allegedly allowed drivers to "cut the line" -- moving them ahead of honest drivers, who were forced to wait in holding lots where they were queued for passenger pickups -- by paying dispatchers bribes of a few dollars, Brown said in a statement Wednesday.
With thousands of cabs servicing airport terminals on a daily basis, dispatchers raked in hundreds of dollars each during an eight-hour shift, Brown said. It also allowed drivers paying bribes to make many additional trips during a shift, authorities said. Authorities said the scam was in effect from December 2012 until February.
Van Etten said that Gateway and the Taxi and Limousine Commission cooperated with the criminal investigation.

At present, the Miami-Dade County Commission has several reform proposals on the table that would significantly change the for-hire transportation market. These changes include among them mandated credit card machines in all cabs servicing Miami International Airport and the Port of Miami, a sweeping reform program called “Ambassador Cabs” for those same two areas supported by Mayor Carlos Gimenez, and an overhaul of the limousine ordinance to make way for digital dispatch services like Uber to operate in Miami.         Uber is a company that’s exciting, innovative, useful, and arguably shouldn’t exist at all. It is a solution to a ridiculous problem created by cartels and overregulation.

        “I wanted to be able to press a button and get a classy ride,” explained CEO Travis Kalanick when I asked him to describe Uber’s origin story to me at a launch event for its D.C. branch on Wednesday. So last year Kalanick, Oscar Salazar, and Garrett Camp founded a company originally known as UberCab in San Francisco.

        The original name made perfect sense, since at root what Uber provides is a taxi service. Just about every major city in America has, in addition to its heavily regulated cab drivers, a largish fleet of private sedan drivers who do things like take businessmen on pre-arranged drives to and from airports. These limo services generally feature nicer cars, higher prices, and—crucially—different moments of peak demand. Car services get a lot of business weekday mornings, and to a lesser extent in the afternoon rush hour. But very few business travelers need a ride from the airport late on a Friday or Saturday night, which is the time lots of drunk young people want a ride home or maybe to a different bar.

        Warning to Uber and Lyft drivers

        "Uber Destroyed My Life

        I was looking for a way to generate some extra income to supplement my veteran pension, give me something to do with my spare time, and most importantly help make the $409/month payments on my 2013 Chrysler 300. I saw an ad from Uber guaranteeing a very lucrative job as well as great working conditions and a secure future. I hired on as an Uber driver and at first everything they claimed seemed to be mostly true. I was earning decent money (though not as much as their ads promised) and was getting plenty of work. All was good until one day I became involved in an accident. It was only then that I discovered that my personal liability insurance did not cover me because my car was being used for commercial purposes. Uber’s mythical “1 million dollar liability coverage” only covered Uber, not me or my car. I am now being sued by the other driver’s insurance company for thousands of dollars and my smashed Chrysler 300 sits in a junk yard racking up storage fees. On top of all of this, no traditional taxi companies will touch me now because of the accident on my driving record.
        I was only trying to earn an honest extra income and now I have no car, just the $409/month payments and a huge pending lawsuit. None of this would have happened if I had been working for a legitimate taxi company that is required by law to provide both a car and commercial insurance for their drivers. If only I had known then what I know now. Uber is a lying, dishonest company that does not give a damn about their drivers and is only out to make a dishonest buck.DO NOT WORK FOR UBER OR THIS MAY HAPPEN TO YOU LIKE IT DID TO ME! "

        Daily temptations of Saint Pete cab driver

        It happened yesterday at Tampa Airport
        Here I am, dropping off passenger at Southwest departure terminal, I am counting money and exchange last few words with my fare and out of nowhere comes to passenger side window this elderly guy dressed up like gangster from 1970 and with heavy Spanish accent asks "how much to Sarasota?"
        I yelled back "about $140" and kept dealing with my passenger.
        After I unloaded luggage of my fare and exchanged few polite thankyous, nicemeetingyous, have safe trip words I got that Spanish guy in to my face again asking "you said, to Sarasota $400?, how about $350?"
        Obviously, when I yelled to him $140 he misunderstood that for $400..
        My mind started to race,- here is the guy willing to pay more then double on the trip from Tampa Airport to Sarasota... it's almost like lottery jackpot for a cab driver, I was about to grab the guy with his carryon (that's all he had) and put him in my cab, but as all Saint Pete taxi drivers know, picking up anybody at Tampa airport is highly illegal without proper licence and only 3 companies are allowed to do that, and those are Yellow Cab of Tampa, United of Tampa and Super Shuttle + number of unmarked Limo operators with proper stickers,- Penalties for breaking this law, are heavy fines, impounded cab and possible imprisonment for 12-24 hours.
        So here I am tempted to take this guy to Sarasota for $350 and at same time thinking, may be its some kind of sting operation by Tampa PD or Tampa Airport Authority to bust dishonest, out of town Taxi drivers who are dropping off at TIA and picking up flags.
        I looked around and I saw that Tampa Airport Authority cop across the street, about 30 yards away looking in my direction and then I made my mind and said to my "elderly Spanish gangster from 1970's", I am sorry Sir, I am a cab from Saint Pete and I am not allowed to pickup at Tampa Airport and I would suggest you should go downstairs to arrivals level where all the local cabs are parked, btw. trip to Sarasota shouldn't cost you more than $150.
        Then I got in my cab still excited by whole situation and drove up to that cop across the street whose presence prevented me from making some serious money that day and asked him .

        Excuse me Sir, I have a question: There is that guy who wants to Sarasota, -am I allowed to pick him up and take him there?
        Cops face looked puzzled, then after few seconds he replied :
        ".......to Sarasota?, only Super Shuttle is allowed to take passengers there"

        Obviously, the cop was pretty much clueless about dynamics and laws at TPA, same like I was dumb for passing up on my opportunity to make money.

        It same applies when you try to get to airport,- you have to wait for other people to get in to the van and then go to airport.
        Question is:
        Is it worth hassle to go through all the trouble just to save $10 on a trip to airport for 1 passenger?
        I think you deserve something better,- call any local cab company and ask them for flat rates to airport and you would be surprised.
        ....and a Trip to Airport by Supper Shuttle for 2-3-4 or 5 passengers traveling together is simple insanity

        Taxi Drivers and Their Religious Opinions

        Eight Florida 'Star Taxi' drivers claim their boss made them choose between prayer and their job
        For a practicing Muslim, prayer is as important as the daily sustenance on food is for people. Understanding this fact has brought about laws that protect both employers and employees against discrimination. Employees losing their jobs because of their race or religion often sue for financial damages and sensitivity awareness against their employers. Some win, some don’t. Everyone is entitled to his or her own opinion and freedom in America is not to be stepped upon by anyone, native or not.

        In Orlando Florida, eight taxi drivers working for a certain cab company were given the option to choose between practicing their religion or their jobs. These drivers are Muslims that need to pray in certain areas for five to seven minutes, five times a day. This means that time on the job has to be sacrificed because it is to their opinion that it is their right to practice their religion regardless of what they do for a living. With this case, the taxi drivers filed a suit against their employer because of the clear violation of state, federal and local laws that sates that employers must give reasonable leeway to drivers as long as it does not become a major draw back for the business.

        “Cab driver” does not sound like it would be on a list of the “worst jobs to have in the summer”, but try telling that to the nearly 200 drivers that work at the San Antonio International Airport.
        “We're all cooking here,” said Ricardo Delvalle. “We have to stay in cars with the A/C running, the engine running. It’s a waste, as far as gas.”

        Unlike airports in Austin, Dallas, and Houston, the holding area for cab drivers at San Antonio International is a large uncovered parking lot.
        There are two small aluminum canopies where drivers can sit in the shade, but without a larger covered area or indoor facility, many of them have to tough it out in the extreme heat.
